INTERNAL INVESTIGATIONS

For example, the CEO of your company informs you that the Board of Directors for your company is interested in all information relating to stock option packages issued in the last two years. The CEO indicates that the company Controller may have backdated the grant date on some executives’ stock options. He asks you to determine the scope of the problem in preparation for the Board of Directors meeting and possible reporting to the FSA, SFO or DTI. After engaging your IT department to gain access to several key e-mail accounts, you create a case in Ontrack Firstview named “Stock Option Investigation” and analyse the information displayed on the communication, subject and timeline graphs. Using keyword searching and external e-mail evaluation, you are able to locate several key e-mails between the Controller and Chief Financial Officer, some reaching their personal e-mail accounts, revealing a blatant stock option backdating scheme.
EARLY CASE ASSESSMENT
When litigation is likely, or as soon as a complaint arrives on your desk, you need to assess the merits of the claim. For example, a former employee files a civil suit alleging gender discrimination against you or your client. ELECTRONIC DISCLOSURE

It is your responsibility to identify custodians, keywords and timeframes, and begin preparing and collecting data to be sent to the organisation's e-disclosure service provider. After engaging the IT department to gain access to an e-mail storage database, you create a case in Ontrack Firstview named “E-Disclosure Collection” and begin identifying key data for disclosure. You isolate key timeframes and custodians by running various searches in Ontrack Firstview. Instead of sending the entire e-mail storage database for e-disclosure processing, you create a few smaller PST files for transport to your e-disclosure service provider, saving time and money while improving accuracy.
